Minatare man agrees to plea deal
A 60 year old Minatare man arrested in July for sexually assaulting a teenage girl and possessing nude photographs of the teen on his cell phone has reached a plea agreement with Scotts Bluff County prosecutors.
David Nielson was originally being charged with four counts of possessing child pornography and one count of 1st degree sexual assault of a child. Court documents indicate Nielson will enter a guilty or no contest plea to amended charges of attempted 1st degree sexual assault of a child, a class 2 felony. The four counts of possession of child pornography will be dismissed.
Court records show that a confidential informant told a Nebraska State patrol investigator that he had borrowed Nielson's cell phone to text when he observed a nude photo of the 16 year old girl in pictures on the suspect's phone. Further investigation indicated Nielsen had four nude images of the girl on his phone.
The court documents say Nielson told investigators he had been having sex with the girl, now 16, since she was 13 or 14 years old. The victim says they last time they had sexual relations was in July of 2011. The incidents allegedly took place at the victim's residence.
