Another suit for non payment of a loan has been filed against Hergert owned U.S. Chicory, this time by Source Gas. Source Gas contends in the suit filed in Scotts Bluff County District Court that U.S. Chicory has defaulted on a more than $74,000 note for gas costs involved in the company's chicory operation. The suit has been filed against the company and does not mention former N.U. Regent Dave Hergert as an individual.

The suit says the note was executed in late March of last year and required twelve monthly deposits from April first iof last year to March first of this year. The legal action asks for the cost of the note, interest and legal costs associated with the suit.
