
NORTH PLATTE, Neb. (AP) _ An attorney says that although a federal lawsuit filed by the mother of a 16-year-old fatally shot by police has been dismissed, the legal battle will continue.
Scottsbluff attorney Maren Chaloupka said Monday that she will refile Pat Britton's lawsuit in Dawes County District Court, likely this week.
Britton sued Crawford Police Chief Rick Thompson, game warden Dan Kling and the city last year, alleging they were negligent and that the city failed in training its employees.
Authorities say Thompson shot Jesse Britton in a vacant Crawford bar in 2007 after Britton didn't obey orders to lower a gun. The boy was a suspect in a string of burglaries. A federal judge said that the officers didn't violate Jesse Britton's rights and that the city isn't liable.
