Judge rejects Goshen school drug testing challenge
Published Friday, November 06, 2009 at 10:30 AM

CHEYENNE, Wyo. (AP) _ A judge has upheld Goshen County School District's new policy of random drug testing without suspicion for students involved in extracurricular activities.

State District Judge Wade Waldrip granted summary judgment in favor of the district last month. That included finding that the drug testing does not constitute an unreasonable search under the federal or state constitutions.

The school board approved the policy in April and dozens of students and their parents filed suit in July.

Schools Superintendent Ray Schulte (SHUL'-tee) says he's pleased with the ruling. He says drug testing is needed because surveys show his district has high rates of student drug use.

The plaintiffs' attorney, Harriet Hageman, (HEY'-guh-man) says she plans to appeal.
