Attorneys Argue Motions In Chadron Molestation case

Attorneys debated more than a dozen motions for nearly 3 hours Wednesday morning in the case of a Chadron man accused of molesting young girls in incidents a decade apart. Jim Brodrick,charged with six counts of sexual assault of a child. is accused of having sexual contact with a then-11 year old girl in the summer of 1994 and with a then-12 year old girl between July 2006 and last April.

Dawes County District Judge Randy Lippstreu took all the motions under advisement, saying he would rule on most of them by Monday but setting a separate hearing on a motion by the state on images of young nude females found on a computer in Brodrick's home.

Special prosecutor Adam Edmond wants to enter the pictures into evidence, but will have to show at the hearing that they are relevant to the case and that Brodrick and not someone else was responsible for them being on the computer.

Defense attorney Maren Chaloupka repeated her request that the state comply with a discovery order issued last fall and turn over to her all the evidence, reports, and statements taken so far. That ruling is among those promised by Judge Lippstreu.

Brodrick is free on a personal recognizance bond that includes having no contact with the alleged victims. During testimony on the motions, the family of one of the alleged victims called for Brodrick to be locked up until the case goes to trial...citing two occassions where they encountered him at public events.

The request was not a formal motion to the court, and prosecutor Edmond...appointed when Dawes County Attorney Vance Haug recused himself...has not made such a request.

Judge Lippstreu plans to hold a teleconference within 10 days to set a date for both a trial and a pre-trial conference. The trial will most likely be held during the June jury term.
