Homicide suspect & wife waive prelims, to face trial

Cheyenne County Court Judge Randin Roland rejected a defense request to reduce Lowery's bond from $250,000 to $25,000. Kelly Breen with the Nebraska Commission on Public Advocacy argued that Lowery was employed, had ties to the area for seven years, and had no reason to flee because $25,000 to someone who is indigent is a lot of money. He also claimed Lowery wanted to defend himself against the charges, noting his claim to Police of self defense. But Judge Roland agreed with Scotts Bluff County Attorney Tiffany Wasserburger that the charges and the possible penalties were too serous to change the bond.
Lowery will be arranged in district court September 30th at 8:30 a.m.
Lowery's 17 year old wife Rozlyn also waived her right to a preliminary hearing for being an accessory to a felony and will face trial in district court. Lowery's attorney Dave Eubanks of Scottsbluff had asked for the case to be transferred to juvenile court, but Judge Roland dismissed the request, saying state law required the motion to be filed in district court not county court.
Lowery, who the court learned is pregnant with her husband's child, is charged with being an accessory for providing false information to Police during their investigation of the death. Lowery will be arraigned Friday in district court.
