Stiffer MIP sanctions Harms priority bill

48th District State Senator John Harms of Scottsbluff has picked his priority bill for the current session, choosing one toughening Nebraska’s Minor in Possession laws. Priority bills are essentially guaranteed a shot at floor debate if they get out of committee.

Harms...the retired president of Western Nebraska Community College... believes underage drinking is a serious problem in Nebraska, and puts part of the blame on weak MIP laws with few teeth.

Harms says his LB-258 his priority bill. It adopts "Use and Lose" sanctions … including the loss of a driver's license for an MIP conviction.

A 1st offense would cost an underage drinker 16-to-21 their license 1-to-2 months and require them to attend an alcohol education class

A 2nd offense would take away a license for 6 months and bring 20-to-40 hours of community service on top of the educational requirement, with a 1-year revocation and 60 hours of community for a 3rd conviction and 2 years of lost license and 5-to-15 days in jail on a 4th violation.

Those under 16 years of age who have an operator's permit would face losing their permits for six months to a year and have to attend alcohol education classes.
