Chadron Wal-Mart suit moved to federal court

Dave Lehman originally filed his suit in Dawes County District Court, but Wal-Mart successfully petitioned to move it to federal court. A pre-trial conference will be held in January with the trial set for February 16th.
Lehman's wife Julie was shopping at Wal-Mart July 21st with the couple's 17-year old son Steffan when she slipped on a wet floor in the automotive department while walking to the store's restroom.
Her head apparently struck the floor, causing a massive blood clot on the brain. She was initially treated at Chadron Community Hospital, then flown to Rapid City Regional Hospital for surgery to remove it. Julie Lehman never regained consciousness after the surgery and died July 27th.
David Lehman...head of security at Chadron State College and a part-time officer with the Crawford Police Department...filed his suit less than 2 weeks later, saying Wal-Mart was negligent in failing to prevent a wet splippery floor. He seeks medical and funeral expenses plus compensatory damage for his wife's pain, and for loss of consortium and future services for him and his two children .
