During court proceedings Thursday, Box Butte County District Court Judge Brian Silverman ordered 25-year-old Tonia Walker to serve two to three years in state prison.
Walker was charged with being an accessory to a felony for driving Waylon Dawn of Alliance from the scene of a first degree assault and harboring him in her residence. Dawn has been charged with felony first degree assault for allegedly hitting another man over the head with a baseball bat on March 6th of this year. Walker also was ordered to serve 90 days in the Box Butte County Jail for resisting arrest.
During sentencing, Judge Silverman noted that Walker was a mother of three children, but questioned how she was capable of care for anyone given her past actions, which consisted of alcohol abuse and associating herself with law breakers. The Judge also noted that Walker's actions also led to an Alliance police officer sustaining minor injuries.
County Attorney Kathleen Hutchinson described Walker as "an intelligent woman with zero common sense," and asked the court for incarceration.
The Judge advised Walker to take advantage of alcohol counseling that would be available in prison. Walker will be eligible for parole in one year.
Also in district court Thursday:
--- 33-year-old Pat Zochol of Scottsbluff was ordered to serve 180 days in the Box Butte County Jail for his conviction of fifth offense drunk driving. Zochol was arrested by law enforcement while driving drunk on Highway Two west of Hemingford. Judge Silverman told Zochol that his crime, which is a class three felony, meant Zochol could have spent up to 20 years in prison. However, the Judge said that Zochol's efforts in attending alcohol rehabilitation warranted a lesser sentence.
